These Terms and Conditions are an agreement between you, the customer, and us, Artena Music LLC.

By accessing this website we assume you accept these terms and conditions in full. Do not continue to use Artena Music LLC’s website if you do not accept all of the terms and conditions stated on this page. You also accept these Terms and Conditions by giving us written or electronic signature or confirmation, by buying any product or service from us, either in person, on our website artenamusic.com, or through email communications and QuickBooks Invoices.

We employ the use of cookies. By using Artena Music LLC's website you consent to the use of cookies in accordance with Artena Music LLC's privacy policy. Most of the modern day interactive websites use cookies to enable us to retrieve user details for each visit.

Cookies are used in some areas of our site to enable the functionality of this area and ease of use for those people visiting. Some of our affiliate / advertising partners may also use cookies.

Unless otherwise stated, Artena Music LLC and/or its licensors own the intellectual property rights for all material on ArtenaMusic.com.

All intellectual property rights are reserved. You may view and/or print pages from ArtenaMusic.com for your own personal use subject to restrictions set in these terms and conditions.

Artena Music LLC uses intellectual property from its partners and brands with their explicit permission.

Prices

Prices listed for all products on ArtenaMusic.com are binding, including any applicable taxes based on customer's location.

Prices for custom clarinet orders listed on ArtenaMusic.com are estimates only (not including "Immediately Available" Clarinets in stock). Finalized price will be sent to customer's on a price quote.

Payment

Artena Music LLC can receive payment through Bank Transfer, Credit or Debit Cards, or PayPal. Payment is due in full at the time of purchase.

On custom clarinet orders, there is a 30% non-refundable deposit due to confirm the order. The remaining balance is due once the clarinet(s) are finished, and before Artena Music LLC ships to the customer.

Deliveries
Delivery of instruments and products is contingent upon Artena Music LLC receiving full payment of the products. The delivery is made by a 3rd party transport company and is insured from door to door, with signature required for delivery of any and all instruments. Artena Music LLC is not responsible for the actions of the 3rd party transport company. No claim for damages or right to withdraw from the contract can be derived from non-compliance with the delivery time.

Cancellation Policy

A customer can cancel their custom order of Seggelke instruments at any time. The customer will forfeit their non refundable 30% down payment of their order.

Return Policy

Reeds - Returns on unopened boxes only. Postmarked within 7 days.

Ligatures/Mouthpieces/Barrels/Bells/Published Music - Returns on undamaged items only. Postmarked within 7 days. Item will be evaluated once we have received it back at our store. Refund approval will be confirmed or denied after evaluation. Must include all original packaging materials.

Barrel/Bell/Mouthpiece Trial Policy

For the price of shipping, we offer in-home free trials of our Mouthpiece and Barrels.

All products selected for a Mouthpiece and/or Barrel Trial will be prepaid by the customer. The customer then has 7 days on receipt of the package to try out the products. The package must be postmarked back to Artena Music LLC by the 7th day. Upon receipt of the goods back at Artena Music LLC, goods will be inspected for quality. If all goods are still in new condition, a refund will be issued to the customer for all goods returned.

- Please take care and make sure to safeguard against scratches on the mouthpiece and/or barrels. We recommend using mouthpiece patches on trial mouthpieces to avoid teeth scratches. Any damage to the returned products including but not limited to teeth marks, scratches, nicks or dents will deem the returned product ineligible for a refund. They will be sent back to the customer and treated as purchased products.

- All returned products must be returned with all original packaging for a full refund.

Warranty Policy

Artena Music stands by the quality and craftsmanship of the products and brands we represent.

All new Seggelke clarinets come with a 2 year warranty from the workshop. Please check the terms of the warranty here.

All new clarinets purchased with Artena Music come with a 3 hour adjustment session with our repair technician (6 hours for a new Bb/A set).

No other products sold on ArtenaMusic.com come with a warranty policy.

Disclaimer

To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website and the use of this website (including, without limitation, any warranties implied by law in respect of satisfactory quality, fitness for purpose and/or the use of reasonable care and skill).

Nothing in this disclaimer will:

Limit or exclude our or your liability for death or personal injury resulting from negligence.
Limit or exclude our or your liability for fraud or fraudulent misrepresentation.
Limit any of our or your liabilities in any way that is not permitted under applicable law.
Or exclude any of our or your liabilities that may not be excluded under applicable law.

The limitations and exclusions of liability set out in this Section and elsewhere in this disclaimer:

are subject to the preceding paragraph; and
govern all liabilities arising under the disclaimer or in relation to the subject matter of this disclaimer, including liabilities that arise in contract, tort (including negligence) and for breach of statutory duty.

To the extent that the website and the information and services on the website are provided free of charge, we will not be liable for any loss or damage of any nature.

Our offer is subject to change in regard to delivery times and pricing. We reserve the right to make technical and pricing changes.

No deviations from these Terms & Conditions will be considered valid unless agreed upon by both parties in writing.
